The male teacher has a constitutional right to REQUEST that people refer to himself with the grammatically incorrect pronouns "She" and "Her", but he does not have the right or the authority to compel others to do so. While the teacher has the constitutional right of free speech while on his own time, his freedom of speech can and should be limited while acting as an agent of the school and school district. If he demands that his students refer to him as "She" and "Her", then the school has the right to terminate his employment with the school if it's breaking school policy for the teachers.

The judge is a first amendment stickler. Seems like the man in question can refer to himself as Ms, her and she. On the same first amendment grounds, anyone else can refer to him as Mr. He and him.

The Court is the one violating the Constitution in this case. There is no constitutional provision regarding pronouns or gender references and no constitutional authority given the court to make law, The constitution gives authority to make law to the people's elected representatives only. Therefore the state, right or wrong, fair or unfair, has every right to make whatever laws it chooses to make regarding that.

The Court would be quite right that the teacher should be able to refer to himself or herself by whatever gender definitions he/she chooses when on his/her own time outside the job. But when on the job, the teacher should be required to adhere to whatever rules/laws are established for school employees.
