Thing is. It's not really a police matter. It's a civil matter.

As for assault, there has to be a "reasonable fear" on the part of the victim that battery will occur. The victim in this case can't reasonably argue he was in fear when he's laughing into the video. Simply touching someone in public isn't going to get anyone done for assault.

Cops will just roll up and ask everyone to grow up and act like semi-adults.

They may escort the recording man out of the store as the storekeeper has the right to ask him to leave the store if he's disrupting trade.
