The court upheld West Virginia’s 2022 law banning mifepristone for abortions in most cases.


A divided federal appeals court on Tuesday allowed West Virginia to restrict access to mifepristone, the pill used to end pregnancies that has emerged as a focal point of legal battles over abortion.
The decision marks the first time a federal appeals court has allowed a state to strictly limit the drug, teeing up a key test of states’ powers to ban medication approved by the Food and Drug Administration.

Mifepristone is the first part of a two-drug regimen for abortion. The medication has been used in more than half of all abortions since 2022, when the Supreme Court in Dobbs v. Jackson Women’s Health Organization struck down the constitutional right to the procedure, according to the Guttmacher Institute, a policy group that supports reproductive rights.

Following the Dobbs decision, West Virginia passed a law banning surgical and medication abortions with limited exceptions, including to save the life of the mother or in cases of rape and incest. Abortion providers face felony charges under the state’s law.

So it seems to me that SOMEBODY ought to do a study to see if the well-publicized abortion ban causes any change in the reproductive behavior of WV's fecund women.

Are they more likely to use birth control, or refrain from copulating with men who are not good "daddy material"?

It is the classic case of static vs dynamic views of human behavior.

Pretending you can practice medicine in Texas or West Virginia without being licensed there is wire fraud.

Listen, if that woman travelled to NY to get the abortion, Texas or West Virginia couldn't do shit, unless she's a minor and not accompanied by a guardian.

This is different, where a NY doctor thinks they can fill a prescription in a State they are not licensed in.

In this instance not only is there comity issues, but NY specifically has a shield law to protect doctors prescribing abortifacients.

I'm more interested in the toxicity of the pills...If they're killing off the zygote/fetus, what long term effects are they having on the women who take the pills?...And no, I don't trust the damned FDA's opinion on the matter.

The New River is a smuggling highway. WV probably just wants to ban it so the god-fearing conservative legislature's nerdowell nephews can make money trafficking it.
