Only those who were never prosecuted (no true bill indictments) would have their record expunged.
And you left out the many who were prosecuted

What Flynn did was not a criminal act.
Had he admitted it to the FBI, he would have walked away, lawyer or no lawyer.

Flynn instead chose to lie to federal agents thinking he was smarter than they were.
