Well ... What you're probably missing is the highly likely satellite surveillance from point of origin which is not something that's going to be shared with the general public. It's understandable that it's not shared with Congress either because there are many congress members that would quickly run to South America and warn them.

Additionally, not having filed a charter with the Coast guard they already know they're in violation of Maritime laws.

Even in international waters once their trajectory has taken them past any other geography that could possibly be in that trajectory and have demonstrated a definite direction towards an undeveloped area of the United States Coast...

There is a very good possibility that the boats are watched from point of origin by satellite.
I have no doubt that the Pentagon has absolute proof that the boats we're carrying drugs.
How they obtain that proof is not something they're going to share with the traitorous Congress critters who would prefer to have margaritas with the drug runners than to protect American citizens from fentanyl.
