"Redacted Mar-A-Lago Affidavit Confirms Biden’s DOJ Fished For A Crime To Pin On Trump

Manipulating the criminal code to find a basis to search the home of a political enemy represents an appalling weaponization of the criminal justice system.

First, the Presidential Records Act is not a criminal statute, and violations of that federal law do not constitute a crime. Second, the Presidential Records Act does not reach broad swathes of documents retained by a former president, including “official records of an agency,” “personal records,” and convenience copies of presidential records. And third, the courts have refused to question a former president’s conclusion that a record constitutes a “personal record” and not a “presidential record.”

The first legal principle of note concerns a president’s power to declassify documents. As Trump’s attorney stressed in a May 2022 letter to the DOJ, which the government released along with the redacted version of the search warrant affidavit, “a president has absolute authority to declassify documents.”

“Under the U.S. Constitution, the President is vested with the highest level of authority when it comes to the classification and declassification of documents,”......Citing both the Constitution and Navy v. Egan, 484 U.S. 518, 527 (1988), wherein the United States Supreme Court wrote, “the President’s authority to classify and control access to information bearing on national security … flows primarily from this constitutional investment of power in the President and exists quite apart from any explicit congressional grant,” Corcoran countered the DOJ’s attempt to frame NARA’s discovery of documents marked “classified” as warranting a criminal investigation."

"The Biden administration couldn’t target Trump for mishandling classified material both because he declassified it and because the statute that criminalizes such mishandling doesn’t reach a president or a former president. So instead, they tried to find a crime to get the man. "

"The attorney for the former president then quoted the statute that criminalizes the removal, possession, or retention of classified materials before stressing that “an element of this offense, which the government must prove beyond a reasonable doubt, is that the accused is ‘an officer, employee, contractor, or consultant of the United States.’” “The President is none of these,” Trump’s attorney continued, before concluding, “thus, the statute does not apply to acts by a President.”

The DOJ screwed up bigly when they took materials not covered under the warrant. Those attorney-client privileged documents just opened up the Poisoned Tree defense.

They knew from the start that the press would cover their derrieres.

And Democrat adherents would simply go "...duh....yup...yup.....duuhhhhhh..."

The only reason they did it was because of the midterm elections and they wanted to give the Dummycraps something to argue with us over for the next several weeks.

All of these hoaxes get knocked down eventually....but by that time, these idiots have moved on something else they've lied to them about.

They've been talking about Jan 6th like it was just yesterday.....and claim that Trump led an armed group of paramilitary members into the Capital. The lie just gets bigger every time it's repeated.

Makes me want to slap the shit out of them when they say it because it's so friggen idiotic.

There was never any reason for ANY of the manufactured crises the Democraps have been creating over the last 6 years to destroy Donald Trump. Russian Collusion, Impeachment 1,2, J6 and now this crapola. Imagine what they might have accomplished for their constituents in 6 years if they hadn't ignored them?

But the half-witted voters, their constituents, are not who they plan to accomplish for.....it is for themselves.

Your honor: We have reason to believe the former President is illegally storing Classified Documents in his residence

Result: 25 TOP SECRET Documents found
You're a liar. Tell us all why such a traitor is still running around free?

Trump was let off the hook by Biden. Biden has declassified every document in the world.

Former Gorsuch Law Clerk Goes Scorched Earth on Latest FBI Trump Raid Development

Davis notes how Congress expects former presidents to possess classified materials. The Presidential Records Act, which isn’t a criminal statute, doesn’t differentiate between classified and unclassified, and ex-presidents have staff with security clearances, secure offices, and Secret Service protection. There was no danger of whatever the FBI alleges was at Mar-a-Lago falling into unsavory hands. Davis again reiterates that Trump declassified the documents in question, kept copies, and was under Secret Service protection.
