Saratoga BLM leader's partner alleges landlord assaulted them during Oct. 24 altercation​


SCHENECTADY — More than a week after Saratoga Black Lives Matter co-founder Lexis Figuereo was arrested for allegedly pointing an AR-15-style weapon at a man outside a Schenectady home, the outspoken activist's partner is alleging the man broke her hand and assaulted Figuereo during the larger altercation.

Gabrielle Elliott said in a phone conversation Friday that her landlord 47-year-old Waldo “Wally” Evora allegedly broke her hand during the Oct. 24 altercation. Elliott also alleges Evora tried to illegally evict her from the Raymond Street residence, where the incident occurred, and where she lives with her three children.
“I'm in the process of also filing charges,” Elliott said. “The police will be coming by today [Friday] in order to take my report and statement in regards to the assault that he did on me and the illegal eviction.”

As of 5 p.m. Friday, she was still waiting to speak with police.
Elliott said she’s been asking Evora to fix the oven at her residence, as well as address mold in her basement, including providing a dehumidifier or air purifier since around Thanksgiving of last year but nothing has been done. She said, since she’s made the request, Evora has been retaliatory, including filing a complaint with the Schenectady Municipal Housing Authority accusing her of breaking a door. She said those accusations are under investigation, but also said they are false.

“As far as I know, it's going to be taken care of,” Elliott said. “As of today, I spoke with the [authority] Executive Director Richard Homenick.”

Homenick could not be reached immediately for comment.

Elliott also accuses Evora of putting up a door to block her access to the basement of the residence where she kept a washer and dryer, which she said she paid for, as well as some of her and her children’s belongings.

Things escalated Oct. 24 when Elliott said she returned to her residence to find her and her children’s belongings outside.

Elliott then alleges Evora choked and punched 37-year-old Figurero and in the midst of the altercation between the three of them her hand was broken by Evora.

Elliott declined to comment on the charge Figurero is facing. Figurero has pleaded not guilty in Schenectady City Court to fourth-degree criminal possession of a weapon, a misdemeanor.

He is accused of using a M&P-15, a semi-automatic rifle, to menace Evora around 2 p.m. outside of the Raymond Street address, according to City Court documents.

Evora also requested an order of protection.

Figuereo said he was unable to comment Friday on the incident but said he plans to hold a press conference in the coming days to address the allegations.

The Daily Gazette reached out to a Facebook account appearing to belong to Evora and received no immediate response.

he still did not have right to point ar-15 at some one.; call a cop for heavens sakes. course this is the hood.
 
If Figueroa’s life was threatened, then I support his right to bear arms in self-defense.
