the middle ground folks that were part of the constituents assembly quit due to Morsi going to far Islamist, article 36 etc. ..........
A vast majority of the people's assembly were Islamists. All of the non-Islamist seat holders added together didn't even total half of what the Muslim Brotherhood had alone.
Also, Article 36 actually wasn't really that bad in terms of historical Egyptian lawsets. Article 2 of Egypt's old constitution set Islam and shariah up as a legal source. Article 36 of the draft would have fallen in line with that (well depending on which draft we are talking about).
The protection against strong sharia has always resided not in the constitution itself (which has long been Islamist) but in the judiciary's interpretation of what constitutes legitimate Islamic sources for sharia. (aka how strong the hadiths' have to be).
