Actually he would have to resign as a member of the House, assume the Office of President in an acting capacity.

I did some research, and it appears that if the election is tossed to Congress, the Senate would vote for Vice-President who would become acting president until the President is determined. Each Senator would get a vote and the first between Vance and Watz to get 51, wins.

The House would decide the President with 26 needed to win as they would vote by state.
