Let’s say two defendants commit identical crimes, but one is black and one is white.

If local prosecutors are retired to take the racial background of the two defendants into account, the question becomes: to what purpose?

Is the idea that a person of color should receive a more lenient plea and sentence offer? If so, doesn’t that mean that the proposed offers have to be different? And wouldn’t that entail that whiteness gets punished?

Whatever happened to the notion of “equal justice” and “equal protection under the law?” When exactly did it become Constitutional to deliberately treat people differently based on race?
