In a Republic, actually
‘A U.S. appeals court urged the Trump administration on Thursday to back off from its escalating confrontation with the judiciary, warning that both the executive and judicial branches risk losing public confidence. In a strongly worded unanimous opinion, a three-judge panel rejected President Donald Trump's administration's request to stop a judge from probing what the government had done to secure the return of Kilmar Abrego Garcia, a migrant it acknowledged having wrongly deported to El Salvador.

The judges, part of the Fourth U.S. Circuit Court of Appeals, said the executive branch represented by the administration and the courts were "grinding irrevocably against one another in a conflict that promises to diminish both."

"We yet cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos. This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time," wrote U.S. Circuit Judge J. Harvie Wilkinson. Wilkinson is an appointee of President Ronald Reagan, a Republican like Trump.’

It's too late.

The Trump regime is already appropriately, factually, and accurately perceived as lawless.

And yes, it is naïve to believe that this corrupt, criminal ‘administration’ will respect the rule of law.

:auiqs.jpg: :auiqs.jpg: :auiqs.jpg:Democrats are really pathetic now. The majority of the country is in Trump's camp with this Garcia thing as well as all things border related. It's an 80% - 20% win for Trump. That judge needs to resign fast. He's lost it. So have you. TDS :auiqs.jpg:

I think this judge is about six years late with his warning. The democrats and their minion district courts have ABSOLUTELY NO CREDIBILITY and I don't have any faith in any of them. My contempt of them is well-deserved.

How about a unanimous supreme court, do they have no credibility either?

Trump's appeal to the higher appeals court for the district Court's request, just failed.

Very direct words by the very staunch conservative judge, was.....scorching.

Washington — A federal appeals court said Thursday that the Trump administration's assertions in the case of a Maryland man who it admitted was mistakenly deported to El Salvador should be "shocking" to all Americans and made an appeal to the executive branch to vindicate the importance of the rule of law.

The brief unanimous opinion authored by Judge Harvie Wilkinson of the U.S. Court of Appeals for the 4th Circuit rejected a request from the Trump administration to pause a district judge's order that required it to facilitate the release of Kilmar Abrego Garcia, a 29-year-old who lives in Maryland, from Salvadoran custody, and explain the steps it has taken to return him to the U.S.

"The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order," Wilkinson, who was appointed by President Ronald Reagan, wrote. "Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done. This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear."

Wilkinson was joined in his opinion by Judges Robert King, nominated by President Bill Clinton, and Stephanie Thacker, appointed by President Barack Obama.

The judge acknowledged that the executive branch has "enormous" powers to prosecute and deport noncitizens, but warned that the administration's actions so far could put U.S. citizens at risk

They just admitted they have no power to enforce anything, and have to beg him to respect their bullshit.

The supreme court needs to step up and put district courts back in their districts.
No "judge shopping" allowed.
No overstepping their authority allowed.

Roberts is a gutless politician.

A judges are not supposed to be political.

The fact that you don’t understand that suggests that you seem to think of courts as weapons to be used against the leader’s enemies is acceptable.

Thst happened in Nazi Germany and across banana republics and Soviet states.

Are you telling us that you think that sort of facist notion belongs in the U.S.

Does Reuters really think that American judges deal in perception rather than the Constitution? Maybe TDS lefties buy into the concept

Chele Garcia is not in a foreign prison. Democrats just can't stop lying.

I'm telling you that the judicial branch is political.
Look at the number of injunctions before Trump, and the number of injunctions against Trump.
True, judges are NOT supposed to be political, but they are.
Democrats are more at risk of turning the US into Soviet Russia with their commie judge rulings.
I am telling you that I want the USSC to put district courts back in their districts, with no "judge shopping", like the USSC just told Boasberg, that the TX district is where this case belongs, and NOT to encroach on presidential authority.

Or the judicial authority of the TX district.
