Tate, who is now 18, was tried and convicted as an adult for first-degree murder in the 1999 killing of 6-year-old Tiffany Eunick. He was 12 when she died and 14 when he was sentenced to life in prison, a mandatory punishment for a first-degree murder conviction in Florida.
In December 2003, an appeals court granted him a new trial, ruling that he should have been evaluated to determine if he was competent to understand the legal proceedings against him.
He then pleaded guilty to a second-degree murder charge and was put on probation.
Tate was arrested last September for violating his house arrest. He was sentenced to an extra five years of probation and told at the time that he could go back to prison if he got into any further trouble.
In his latest brush with the law, Tate faces charges of armed burglary with battery, armed robbery and probation violation.
Police said he forced his way into the Pembroke Park, Florida, home of a 12-year-old friend and repeatedly hit the boy, and then met a pizza delivery man at the door with a handgun.
