Rule as the Constitution says.

1. Textualism is a mode of legal interpretation that focuses on the plain meaning of the text of a legal document. Textualism usually emphasizes how the terms in the Constitution would be understood by people at the time they were ratified, as well as the context in which those terms appear.
I am a textualist.


2. Trump imposted those tariffs for the best of all reasons....the interests of America.

Article 1, Section 8 provides that the Congress “shall have Power To lay and collect Taxes, Duties, Imposts and Excises.” The president has no authority in the Constitution to unilaterally impose tariffs without an act of Congress. 4. The three who do not belong on the Supreme Court, Kagan, Sotomayor, and Ketanji Brown Jackson, are expected to vote against Trump.


5. But I am sorely disappointed in my favorites, Thomas, Alito, and Kavanaugh, who should have adhered to the Constitution.

Another part of the Constitution bars states from setting their own tariffs on goods, with some exceptions. Article I, Section 10, Clause 2 reads that “No State shall, without the Consent of the Congress, lay any Imposts or Duties on Imports or Exports, except what may be absolutely necessary for executing its inspection Laws.”

Out of curiosity I checked on the characteristics of a conservative....I consider myself so, and thought of my favorite Justices as conservatives.



Since that time, many other conservative organizations and lawmaking bodies nationwide have adopted this list as their own.

I see that no where is textualism or originalism listed.

I thought they did. Congress can and did pass various pieces of legislation that allows the president to impose tariffs if certain conditions are met, and many presidents have used that legislation to levy tariffs. But the particular legislation that Trump used was determined to preclude the tariffs that he imposed in his 2nd term, correct? So, he's going to use other legislation to impose his tariffs in a different way.

So, where's the problem here? You can't allow any president to do as he pleases without requiring his actions to be anchored in law. That is why Biden's blanket student loan forgiveness was struck down, presidents have to stay in their lane.
