The trump administration has asked the Supreme Court to rule on his plan of using the alien enemies act to deport suspected members of foreign terrorist gangs.


Obviously, it is in nobody’s best interest for the court rule that the courts hold this particular executive authority.

In the unlikely event that they ruled that, yes, all 700+ lower court judges have the authority to dictate to Donald Trump the elected president how to run the executive, Trump will have to decide whether to obey the Supreme Court and bring the terrorist back to the United States to kill again, or whether to proceed in the best interest of the country and be willing to suffer the media, accusing him of causing a “constitutional crisis.”

I would call it a constitutional turning point, not a crisis. Either way, we have an ongoing humanitarian disaster that the president is trying to alleviate. The Supreme Court is not the nations assisted suicide counselor.

The fact that the first thing asked about proposed legislation is not whether it is good for the country, but whether it is Constitutional proves that having a Constitution is not good for the country.
 
Trump is just exercising the same latitude in defining a "foreign enemy" that the courts routinely use in their decisions.

As soon as Judge Biasberg issued the TRO, Trump should written a letter to John Robert’s reminding him respectfully that deporting foreign terrorists is - of course - an executive power not subject to management by the courts.

Trump should say that he is instructing his officers to continue as if Biasberg’s restraining orders have no force of law and his DOJ to avoid lending them a false patina of legitimacy by appealing to higher courts or in any way responding to such lawsuits in the future.

Or not. It really doesn’t matter for the next four years. Donald Trump is the president and so those decisions are up to him.

Next time try running a real candidate if you don’t like it.
