In just over a month from now - October 8th - the trial will begin for Daniel Penny the man who used a chokehold on the subway passenger Jordan Neely, this could get pretty heated as we approach an election. Penny has pled not guilty to the charge of second degree manslaughter and criminally negligent homicide.

I hope that Mr. Penny is using this time out on bail to master the art of keistering his shiv, because in far left New York City, he doesn't stand a chance of a snowball in you know where. Due to the DA's record of supporting criminals over lawabiders, I can't see why he didn't get a change of venue to Jamestown or Olean, or one of the other civilized areas of New York state.

Most places in America have a majority of honkies, SBB. That's what they mean when they say black people are a "minority", it isn't a slur.

Its hardly a "right wing" area politically, actually quite centrist and generally very poor. NY State's restrictions banning fracking have left the people there economically decimated and they probably would appreciate the business a trial would bring as well as the jury pay for their people.
 
So, if I shoot someone and they still have a pulse when the police get there and they die on the way to the hospital, then they can't charge me with murder. Is that what you are saying?
Shooting someone isn't the same as asphyxiation. Shoot someone and they can die of organ damage and blood loss an hour later. If Neely had a pulse and was breathing, he wasn't asphyxiated. There was a failure to provide emergency care due to a fear of hepatitis. Likely the cause of death.
