This case is slowly being dissolved. The judge realizes if this lands in the SCOTUS, because if the appeal fails and holds SITTING PRESIDENTS criminally liable, it would change everything in our country. Democrat presidents could then be sued for starting wars without congress and any other issue American's "disagree" with. She doesn't want to be the bearer of that on her shoulders.
One commenter puts it nicely what's at stake:
