The court's were very clear back in the day when they used the word domicile and that being subject to a foreign power negates birthright citizenship in this country.

Example: If an Iranian couple were to set foot on American soil, and they weren't domiciled in America, and they are foreign nationals who hold and allegiance to their country of origin (why wouldn't they?), then the child would also be the subject of a foreign power as a foreign national, and therefore he or she wouldn't qualify under such conditions in order to become an American citizen by way of a birthright citizenship.

Birthright citizenship only pertains to legal immigrats seeking asylum or legal immigrants gaining their citizenship by going through the proper channel's.
