3rd circuit will re-hear, en banc, NJ's AW/magazine ban

3rd circuit, today.
Before the 3 judge panel ruled on NJ’s AW/magazine ban, the circuit, sua sponte, issued an order that the case be re-heard en banc. All active judges.
The panel was almost assuredly going to vote 2-1 to uphold the ban; thought is the majority of the court found their ruling inconsistent with current 2A jurisprudence from the SC.
Oral argument Oct 15.

Big news -- the 3rd circuit is more likely than not (7/6) to overturn the bans.
This creates a split in the circuits.
Remember Kavanaugh's comments earlier this year?

I have not read the text, but 2AF and FPC are happy with their performance the reception from the justices.
Panel was 9:6 GOP appointees.
Maybe we will finally get that circuit split, and Kavanaugh will get on board with granting cert.
