Polygamists should make the Hobby Lobby argument. Claim that polygamy is rooted in a sincere religious belief that a man marrying more than one woman is part of God's plan,

thus to refrain from doing so is a violation of that belief, and to be denied the right to a legally recognized polygamous marriage is a 1st amendment violation.
