The Trump administration switched sides Wednesday in a case pending before the Supreme Court that could retroactively nullify tens of thousands of agency decisions.

The case, Lucia v. SEC, has major implications for the process by which federal agencies try or punish those in violation of laws or regulations.

The litigation concerns an agency’s decision to allow career bureaucrats to preside as the functional equivalent of judges during enforcement proceedings. These officials, called administrative law judges (ALJs), are hired by career bureaucrats. They are not appointed by the president, a court or an agency head, but they exercise significant authority on behalf of the U.S. government in official proceedings.

ALJs can, among other things, issue subpoenas, make decisions about the credibility of witnesses or the admissibility of evidence, and issues provisional rulings that are generally upheld on final review — if a final review occurs at all.

I am wondering if even the Leftist Justices will side with the plaintiffs, as ALJ's are obvious usurpation of judicial actions by the executive branch.
 
You have no idea how big this is. It is no exaggeration to speak of tens of thousands of past decisions. the Court will be reluctant to do anything with such profound implications, even it is obviously the correct thing to do.

But some of these may be retained because of contractual provisions whereby Government Contractors agree to be bound by such decisions in disputes with the agency.

Why is governing always measured by action, rather than restraint? A government that governs best is one that governs least. Making good governing decisions more often than not requires inaction or stopping conduct that does not serve the governed.

If that type of governing is not for you, might I suggest immigrating to a place that does fit your ideal....in other words, get the fuck out, commie.

This is the incremental creep of government expansion that never stops. The career politicians within the government are always looking for ways to move up, extend their power, grow the number of people they supervise, and and get rich on tax money. How many of these 'public servants' become multi-millionaires AFTER entering politics? Bravo for President Trump's administration for addressing it.
