The Principle Question:

Having made that point, it is not reasonable to assume that with over seven decades of struggle, either side is going to feel compassion for the other. And neither side is going to accept the remodeling of conditions that set the stage for a peaceful solution.

Neither side is politically or economically set to accept outcomes that do not result in outcomes that favor their demands. Certainly, the Israelis are not going to accept any position that will potentially compromise the original concept of a secure and defendable environment for the Jewish National Home (JNH). The are not going to accept any negotiated position that will allow the Arab Palestinian (Black and White checkered headdress – historically of Palestinian origin.) to assume a dominance demographically or a dependence economically that would threaten the Jewish way of life. The Israelis are not going to place any aspect of their survival or future security in the hands of any Arab culture (To be an Arab, like an American, is a cultural trait rather than racial.) that has the first and last word.

Arab Palestinians tend to see the world and events as isolated incidents, snapshots in time yet historically significant, and particular moments being pivotal in nature. Unlike the Israelis --- that tend to look for unifying concepts --- the Arab Palestinian focus on parts, rather than on the whole (actions of a small cell are not required to be in the best interest of the family, tribe, people or culture). A productive terrorist attack --- whether it by at the Munich Olympics or a Jerusalem synagogue, attacking worshippers praying inside with meat cleavers and a gun --- is an honorable objective; without regard to the impact on the reputation of the culture. When Saleh al-Arouri, a senior official, and a founder of Hamas's military wing --- the al-Qassam Brigades (named after Izz ad-Din al-Qassam, AKA: al-Qassam Brigades, EQB), praised the Brigade and “blessed the heroic action” in the kidnapping and slaying of three Israeli teens in the West Bank --- demostrating the level of depravity (moral corruption and wickedness demonstrated by a lack of spiritual values within the Islamic Resistance Movement) the Arab Palestinian has accepted as a societal norm in their culture.

The level of "oppression" the Arab Palestinian makes claim to, relative to the limited Israeli administration of the Occupation, is a direct response to Hostile Arab Palestinian (HoAP) offenses which were solely intended to harm the Occupying Power; including seriously damage the property of the occupying forces, and cases where the person is guilty of espionage, of serious acts of sabotage against the military installations of the Occupying Power or of intentional offenses which have caused the death of one or more persons. (Violations of Article 68, Fourth Geneva Convention) The HoAP attempt, using the morality associated with the Jihadist and Fedayeen, intentionally provoke and encourage --- threat to the peace, breach of the peace, or act of aggression; as opposed to seek early and just settlement of their international disputes and grievances by negotiation, inquiry, mediation, conciliation, or arbitration, through peaceful means. The idea that violations by the HoAP are some justifiable form of "self-defense" is totally without foundation; with the actions of the HoAP well beyond the Principles of International Law concerning Friendly Relations and Co-operation among States in accordance with the Charter of the United Nations.

It is generally understood that Article 43 of the Hague Regulations (1907) --- and --- Article 64 of the Fourth Geneva Convention (1949) constitute the most essential rules defining and delimiting an occupying power’s authority in occupied territory. These two essential requirements articulate the foundational obligation the State of Israel has to restore and ensure public order and safety in occupied territory and the extent to which the Israel may change local laws and initiate new legislation. When the HoAP, through belligerent activities, prevents the accomplishment of the prime obligation --- the restoration of public order and safety --- over an extended period of time, and presents a threat both regionally and internationally, it is to be expected that Israel (as the Occupying Power) will gradually increase law enforcement and security functions until the level of HoAP violence and lawlessness reach a tolerable level. The Israeli response, to HoAP belligerence, imposes a body of law and countermeasures upon the activities of the HoAP until the threat to Israel itself and the Article 68 (Occupying Power and Administration) reaches a nominal level associated with a contemporary society.​

The Question of Cease-Fire:

While the entire question of a "Cease-Fire" between the Israelis and the Palestinians is a matter of a negotiated outcome, there is yet an issue to be resolved --- that issue being an act of war (Hostile Aggression)!

The concept of an "Act of War" is made complicated by the fact the HoAP was not a "state" party to the conflict in 1948 --- over the Israeli Declaration of Independence. However, the definition (internationally) of "aggression" was not really agreed upon until December 1974 [A/RES/3314(XXIX)]. The 1948 War is not yet declared over, in that a treaty has not been negotiated between Lebanon and Syria. But relative to the West Bank and the Gaza Strip, that part of the conflict is an irrelevant point; as neither of those two parties to the conflict border the disputed regions of the West Bank and the Gaza Strip. In the practical reality of the situation since 1948, the HoAP has initiated a "war" against Israel.

13. In conclusion, the Arab Higher Committee Delegation wishes to stress the following: (16 FEB '48)

    (a) The Arabs of Palestine will never recognise the validity of the extorted partition recommendations or the authority of the United Nations to make them.
    (b) The Arabs of Palestine consider that any attempt by the Jews or any power group of powers to establish a Jewish state in Arab territory is an act of aggression which will be resisted in self-defense.
    
    (c) It is very unwise and fruitless to ask any commission to proceed to Palestine because not a single Arab will cooperate with the said Commission.
    
    (d) The United Nations or its Commission should not be misled to believe that its efforts in the partition plan will meet with any success. It will be far better for the eclipsed prestige of this organization not to start on this adventure.
    
    (e) The United Nations prestige will be better served by abandoning, not enforcing such an injustice.
    
    (f) The determination of every Arab in Palestine is to oppose in every way the partition of that country.
    
    (g) The Arabs of Palestine made a solemn declaration before the United Nations, before God and history, that they will never submit or yield to any power going to Palestine to enforce partition. The only way to establish partition is first to wipe them out — man, woman and child.
    

Prior to the 1948 War of Independence, the HoAP were the armed opposition opponents in a civil war with the Jewish citizenry; opposing Jewish independence pursuant to UN Guidance and endorsement.

All the state parties to the conflict, which had standing in the 1948 War of Independence, had resolved their differences via a Peace Treaty.

The HoAP in the Gaza Strip opposed the Israeli occupation in favor of the Egyptian occupation between 1967 and 1979. Thereafter the Gaza oriented HoAP became a non-state actor in terrorism until 1988. Similarly, the HoAP of the West Bank opposed the Israeli occupation in favor of the Jordanian Sovereignty between 1967 until 1988. Thereafter the HoAP of the West Bank became a state (Palestine) supported asymmetric terrorist activity opposing Israel ever since.

Since the War of Independence in 1948, the HoAP have had a long standing policy of opposing Israel and its allies though terrorist acts which include:​

    • kidnapping or hostage-taking;
    • causing extensive destruction to a public or private facility, including information systems;
    • seizure of means of public transport, such as aircrafts and ships;

Since the State of Palestine (alla 1988) has not entered into a good faith effort in reconciliation and has no recognition of "Israel" and the legitimacy of its presence on any part of Palestine; using this as a basis for continued hostile activity, the internationally recognized State of Israel has had little alternative but to establish such measures as necessary to protect its citizenry and sovereignty from the Islamic Resistance Movement and the supporting Jihadist and Fedayeen.
