He is using the tired old lie that black people go to jail more than whites for the exact same crime. But that little misleading fake fact has been disproved over and over because they do not factor in previous criminal record. No matter the race, one is far less likely to go to jail for a non violent crime if they have no record, or years and years since a previous arrest vs. someone who has a lengthy record.

And you are exactly right. It is not racism to point to the OBVIOUS fact the blacks commit more crimes, particularly violent crime. And this will continue as long as those on the left continue to give them a pass for doing it.
