What is Justice?

You hear the term many times, in my variations, but basically it is: "We will obtain justice for the victim". However, justice for the victim is rarely possible in a criminal case, and is a completely misused term, when used in that regard. The only possible justice for a victim is to make them whole again. You can't bring murder victims back to life, and rarely is stolen property recouped by a robbery victim.

Justice applies to applicants and respondents in civil cases, and to the defendent in criminal cases. I refer here to the criminal justice system. Justice occurs when a defendent receives a fair and impartial trial, by a competent judge, or a jury of his/her peers, and if guilt is determined, the sentence fits the crime. That is what the justice system is all about.

We don't try the accused to obtain vengence for the victim. We try a person for violation of a criminal law.

Do you see a flaw in this line of reasoning.
