NASHVILLE, Tenn. — A Black man whose fate was decided by an all-white jury who deliberated in a room containing Confederate symbols will receive a new trial after a Tennessee Criminal Appeals Court ruling.

Tim Gilbert was sentenced in June 2020 to six years in prison for aggravated assault and other charges connected with a 2018 altercation. But Gilbert and his attorney argued the symbols on display at the Giles County courthouse, the jury's racial makeup, and specific evidence allowed violated his right to a fair trial.

Unbeknownst to Gilbert or his attorney at the time of the trial, the jury considered whether Gilbert was innocent or guilty in a room where an antique Confederate flag and a portrait of Confederate President Jefferson Davis hung.


Surely none of this played a role in them finding him guilty and sending him off to prison. We just saw an All White Jury convict 3 racist in Brunswick GA surely an all white jury in Tennessee wouldn't discriminate against a black man.

Are you arguing that he is not guilt because he didnt commit assault?

I tried to find out more about his arrest and indictment but the lib media is marching in know nothing lockstep over the confederate flag story

He is arguing that the guy has a valid argument that he can't get a fair trial in a county that still hangs the Confederate flag in their courthouse.

C'mon SuperConspiracyBruth. This is terrible. The confederate symbols didn't influence that jury.

I do support giving the guy another trial and removing the confederate symbols from the deliberation room, but not because those symbols somehow influenced the jury's verdict.

His attorneys also argued that "the jury's racial makeup, and specific evidence allowed violated his right to a fair trial." It is more likely that the judge improperly allowed "prejudicial" evidence about the defendant.

In other words, Tennessee (like Texas) follows the Federal Rules of Evidence. Rule 403 allows the Court to exclude evidence that may have been "relevant" but that was so inflammatory, confusing, or cumulative that it influenced the jury to reach an improper verdict. THAT is what likely occurred and why I DO support a new trial.

That's one of those things that I am fighting for courts to consider, especially given how "street-gang" culture has influenced attitudes. For example, just because a black man has dreads or looks certain way does not mean he is a "thug." Showing a jury photographs of him looking like a "thug" unfairly influences the jury to conclude that he probably committed the crime alleged. THAT is real.
