This is starting to get comical, were it not for Manafort being held in solitary confinement yet h aving been convicted of no crime.

Ayliff was mostly providing foundational testimony regarding the basic functions of a tax-preparation company. Prosecutors then moved on to specifics and attempted to “publish” one of Manafort’s e-file forms. Judge T.S. Ellis III‘s weariness all but amazed the courtroom as he denied the request–complete with an actual and pronounced finger-wag–before shouting:

"No! You move it along!"​

(It probably hadn’t helped matters that court had just minutes ago returned from a lengthy recess due to the prosecution calling Ayliff out of the witness order provided to both the court and the defense. But as Judge Ellis noted yesterday, he has “a long memory.”)

Composing themselves again, the prosecution moved slowly forward before asking Ayliff to define the term “financial interest.” Ayliff began to answer the question but was immediately cut off by Ellis who noted that Ayliff was not a noticed expert. The defense then belatedly objected, prompting a quick and sarcastic dressing-down from the judge–but it was again the prosecution’s turn for scorn.

Static filled the courtroom as the longest bench conference of the day ensued. Upon returning to Ayliff’s testimony, the jury learned that the issue had been deferred until Friday–if ever. Then, Assistant U.S. Attorney Uzo Asonye asked about another term of art contained on federal tax forms.

Judge Ellis, who was already standing by this point, advised Ayliff to wait and announced the court would recess early.

After the jury left, Ellis took a few minutes to tell the press and public all about the bench conference. As it turns out, not only was Ayliff a non-noticed witness being asked to give the equivalent of expert testimony, but the prosecution and defense had already agreed on what the term “financial interest” meant. Moreover, this agreement was provided on a proposed–and approved–jury instruction.

That is, not only was Ayliff not an expert and not a noticed expert as necessitated by the Federal Rules of Evidence–but his testimony had the potential to derail an already-agreed-upon definition of the term(s) in question. This, Ellis said, could have “confused or clouded” things for the jury.​
 
Poor pooch... During last 2 years Mueller has proved he can't do anything well, even screw the pooch.

It's looking like Mueller isn't the expert lawyer he was cracked up to be, that's for sure.
 
Jesus Christ... I can't believe how many people actually think Mueller is in court trying this case.
He presented a weak case to the court hoping Manafort would lie and give some dirt on POTUS

Let me repeat this one more time... Mueller IS NOT trying this case in the court. The crap you guys are posting has to do with the prosecutors IN THE COURT ROOM making faces, saying phrases the judge doesn't like, and showing too many pictures the judge doesn't like. Mueller isn't doing any of that. The case is all on paper and quite easy to follow. The guy has committed tax fraud, bank fraud, and many other offenses.

Let's get something VERY clear. What is going on in this case is something that happens in about EVERY criminal case. They charge people with as many charges as they possibly can that fits within the evidence, use that to see if they can make a plea deal, and if not let the jury sort out which charges sticks given the trial. You can always drop charges during the trial or see the jury find them not guilty of those charges... because they aren't going to do a new trial down the road on new charges that they could have charged them with before. It's common sense and nothing any different than what happens in EVERY criminal case.

Either many of you have no idea how the criminal justice system works, or you are so partisan you purposefully ignore it so that you can fain fake outrage to attack Mueller as a defense mechanism to support Trump.
 
I am going to be very surprised if Judge Ellis doesn't throw the case out, with prejudice and release the jury, citing prosecutorial malfeasance and misconduct..

The whole thing is obviously an attempt to squeeze Manafort to cough up shit on Trump.

But it would seem that Manafort has steel balls and that the Mueller team is not used to.
