No charges for Amtrak engineer in fatal 2015 Philadelphia crash

may 9 2017 The Amtrak engineer behind the Philadelphia train derailment that killed eight and injured hundreds in May 2015 won’t be criminally charged, the city’s district attorney announced Tuesday.

“The evidence indicates that the derailment was caused the engineer operating the train far in excess of the speed limit,” the Philly DA’s office said in a statement announcing it had wrapped its investigation.

“However, we cannot conclude that the evidence rises to the high level necessary to charge the engineer or anyone else with a criminal offense.”

Prosecutors found no evidence that 34-year-old Brandon Bostian “acted with criminal ‘intent’ or criminal ‘knowledge’” when he accelerated Amtrak No. 188 to more than twice the speed limit on May 12, 2015, the office said.

Eight people died and more than 200 were injured when the Washington, D.C.-to-New York City train careened into a sharp 50-mph turn at 106 mph just after its stop in Philadelphia.

Bostian was distracted by radio dispatches before the fatal crash, the National Transportation Safety Board concluded last May, calling the crash a “standard human error.”
