Obama and the Constitution

Various conservative groups are spreading rumors and making statements about
Obama, what he will do and what they will do to him.

1.Impeachment.According to the Constitution, the President may only be impeached for"treason, bribery, or other high crimes and misdemeanors."

That means he can only be impeached if he commits a crime. He cannot be impeached just because someone does not like his policies.

2.Changing the Constitution. According to the Constitution, amending it requires a vote of 2/3 of both houses of Congress and ratification by 3/4 of the state legislatures. Obama cannot do it by himself.

1. "High crimes and misdemeanors" has never been fully defined, and is not synonymous with "felonies under Federal law." While the process would be procedurally and politically messy, a strong case could be made that Barry should and could be impeached because he flouts his oath of office constantly by ignoring the Constitutional separation of powers and subverting the laws he is sworn to uphold. The examples are too numerous to count, but start with U.S. immigration laws, which he feels comfortable re-writing every day.

2. The meaning of the Constitution is changed regularly and, in my opinion, unconstitutionally simply by Congress and the USSC ignoring it. At least half of what Congress does on a day-to-day basis is not authorized under Article I, and prohibited under the Tenth Amendment. The Supreme Court regularly evades the clear meaning of the Constitution (and the laws passed by Congress) through transparent sophistry, resulting in "Constitutional law" that either ignores or directly contradicts the clear meaning of the Constitution itself.

What "rumors" are you referring to...or did you just make that up, like you do most of the time?

So what are high crimes?

Felonies under law,
Seditious activity,
Flouting the laws and Constitution,
Bringing infamy to the office of the President through outrageous conduct,

Impeachment is a political process, not a legal one. With the correct votes Obama could be impeached anytime and removed from office. The problem is that impeachment could backfire on the party doing the impeaching, so its greater use is as just another political ploy. It sure doesn't seem to get people too upset. The Court only requires the procedure be followed as per the Constitution.

1. Do you consider violating his oath of office to be an impeachable offense?

2. See above. Did someone say he has amended the Constitution? If so, who?

P.S. A Constitutional Convention to propose amendments can be called by 2/3 of the States.

Are those your opinions of "high crimes" or from a source?

In reality whatever Congress decides it is.

Congress could impeach Obama for being Black while President and it would be legal.

Luckily Congress realizes that impeachment proceedings that looking blatantly partisan might cause them political problems- so that is why they talk a great deal and say that President Obama has done this or that wrong- but they don't go near impeachment.

Not only backfire- but the first time that there is an impeachment and a removal from office on what appears to be partisan grounds- the next time the opposite party is in power, they will do the same thing.

Abusing the impeachment process would be a step down the road to a banana republic.
