Michigan Audit Lawsuit Tossed Out of Court on a Motion to Dismiss

This is so damn tiring, and it's tiring because it's a completely unnecessary waste of time. Having said that, I get the impression that these unwarranted lawsuits are going to continue for one reason and one reason only: To appease the ego of a man who refuses to face reality.

Michigan Judge Flatly Rejects ‘Last of the Lawsuits Attempting to Undermine Democracy’ in Big Loss for Trump Fans Who Believed an Audit Would Show Fraud

A judge in Michigan dismissed a lawsuit on Monday that was recently promoted by former president Donald Trump as a “major” case.

The lawsuit, which aimed to force a new audit of the 2020 presidential election results in Antrim County, apparently wasn’t strong enough to live past a motion to dismiss filed by Michigan’s secretary of state and the Antrim County clerk’s office.

Thirteenth Circuit Court Judge Kevin Elsenheimer ruled that the lawsuit filed by Michigan resident Bill Bailey lacks the legal grounds to move forward due to a statewide post-election audit that finished up in March, according to Cadillac-based CBS affiliate WWTV.

“There is no right, either in the constitutional section, or in the statute, for the independent audit that Mr. Bailey seeks as a petitioner under article 2 section 4,” the court noted. “The plaintiff does not get to choose his own audit criteria, rather the legislature is given that authority. So while a citizen may seek to audit the results of the statewide election, it must do so according to the law. That law provides for performance of the audit by the Secretary of State. There is no other relief available to the plaintiff on this point.”

According to the outlet, Bailey originally filed his lawsuit in order to take stock of a marijuana-related ballot measure that came down to a close recount. Pro-Trump forces later attached themselves to the effort, and the litigation became something of a cause cÊlèbre among the most diehard MAGA loyalists, who largely and erroneously believe the 2020 election was stolen. There is no evidence of widespread voter or electoral fraud during the election, and Trump himself actually won Antrim County.

Determining that Bailey’s claims were moot, the judge noted the audit had already been conducted.

“I am saying that, as pled, the plaintiff’s request for an audit is not available,” Elsenheimer said. “[An audit] did occur and it appears to have been done so pursuant to authority.”

basically, the judge is saying that if your state legislature is corrupt and your voting system is corrupt--your screwed. You have no recourse when they commit fraud during elections.

Ah, good morning. There is Turtlesoup, one of my most fav posters.

So, Turtle, riddle me this: You allege the Michigan Legislature is corrupt.
You do know, I'm sure that both the Michigan lower house (Representatives) has 58 Republicans and only 52 Democrats.
And the upper house (Senators) has 20 Republicans and 16 Democrats.

In short, the Republicans control the majority of legislative votes in Michigan.
And so our prolific poster, Turtlesoup, suggests that Michigan's legislature is corrupt.

The poster's lack of confidence in the GOP is notable.

But as a personal note from my overworked avatar: We believe that the poster Turtlesoup has demonstrated credibility and gravitas that is considerably short of adequate in many many postings.

Now, admittedly, we could be mistaken.
However, we firmly assert we reman open to persuasion otherwise.

So, if anyone wishes to argue that Turtlesoup does, in fact, generally knows what he (she?) is talking about....well, here's your chance to articulate your brief.

Just sayin'.

It means that an individual citizen has no right to make new laws and procedures through the court.

You know, because that would be insane.

ahem, excuse me, but the legislature didn't change the election law, the law was changed by the Secretary of State. Demofk!!!

Because,........legislature changes election rules. Those fking facts always smack a demofk square in the chops. FRAUD

Not fraud. Not any votes to change in the ruling against a rule change.

"The Secretary of State’s instructions to clerks further said signatures with any “redeeming qualities” -- described as those having “similar distinctive flourishes” or those with “more matching features than nonmatching features” -- should be validated.

Only signatures with “multiple significant and obvious” inconsistencies should be questioned, Benson advised, according to the judge’s analysis of the rule.

Murray determined the guidelines fell within the definition of an administrative rule and therefore should have been approved through the formal rule-making process.

The ruling leaves certain standards for accepting absentee ballot application signatures at the discretion of the local clerk, unless the Legislature created legal guidelines or the Secretary of State’s Office creates administrative rules for that determination.

The Michigan Republican Party and Allegan County Clerk Robert Genetski, who jointly filed their complaint prior to the Nov. 3 election, claimed the signature standards allowed for “invalid” ballots to be counted.

Murray noted in his opinion that Genetski, however, never claimed the “guidance caused him to accept a signature that he believed was invalid.”

secretary of state has no authority, by law.

"secretary of state has no authority, by law."
--------------------------------------------------------------------------------------------

Well, it looks as if the suggested new standard for accepting signatures that ain't exactly like the signature on record falls under 'administrative rule'-making, and not 'law' making.

Which seems reasonable.

Also what seems reasonable were the guidance offered, to wit:

signatures with any “redeeming qualities” -- described as those having “similar distinctive flourishes” or those with “more matching features than nonmatching features” -- should be validated.

And who can't applaud that?
It goes to the ethic of making sure that as many citizens as possible can have a say in their representation via an open vote. To be barred from your say, because you didn't dot an i, or squeezed your 'r' tighter than you did 2yrs ago when you registered ain't what adult civic responsibility is. Or what common sense offers.
Everybody gets a vote......even those with less than perfect consistency when signing their signature over a period of time.

Good for Michigan.

IMHO

Idiot---I'm an independent because both parties are corrupt-----politicians go to washingon or the michigan capital to rob taxpayers...see Gov Whitmer for instance. How quaint that you think having an r or a d behind their name would make a pol not corrupt.

Progressives are apposed to democracy.
That is why they use rigged elections and voter fraud to undermine our elections.
The big problem seems to be that Dem Voters are dumb and easy to manipulate with crass propaganda.

It’s not the Dems that are buying into conspiracy theories and lies being put out by outfits called “one news now”.

There are far more Democratic voters in the United States than there are Republicans and that is why the Democrats have no need to cheat in order to win, and Republicans can’t win an election without cheating.

They are not finished. They will keep trying to expose the more than obvious fraud.
How is it that something that's supposedly so obvious can't be found? After all, you know what they say. Even a blind pig occasionally finds an acorn.
It was found. The courts refuse to look at that evidence.
Low I.Q. Clown, maybe Trump's lackeys forgot to mention Italian sattelites changing ballots to favor Bidee? Or dead guy Chavez? Bamboo?

Supreme court...take it there...elections must be above board and fraud free and we all know that they are not.....

They took it there. More than once. The Supreme Court, with three Trump judges, tossed all of the cases.
They didn't take the case...they never looked at any evidence....the court said its a state issue....just like they said this morning when they allowed the AZ election rule changes to remain in place....big win for AZ voter fairness....and now we see the dems trying to attack the states that are securing their elections....shows you who the scum really is....

"...basically, the judge is saying that if your state legislature is corrupt and your voting system is corrupt--your screwed. You have no recourse when they commit fraud during elections."
