Jennifer Marchant was convicted in the death of her live in boyfriend. She argued at the time, and since, that it was self defense. The prosecutor disagreed, and the Jury Convicted her of First Degree Manslaughter.

Today, that conviction was overturned. Jennifer will be freed from prison once the paperwork signed by the Appeals Court arrives ordering her release. The appeals court ruled that the jury did not adequate consider the evidence and testimony that said it was self defense. The Prosecution argued during the trial, that the amount of force she used was excessive.

Both Jennifer and her boyfriend called 911 during the argument. Jennifer to say her boyfriend was attacking her, the boyfriend to argue that Jennifer was drunk in violation of her probation. Two doors in the apartment were smashed in by the boyfriend, including the one to the bathroom where Jennifer had barricaded herself with a knife she had gotten from the kitchen.

She stabbed him when he entered the bathroom, and grabbed her by the hair.

Now, I'm thinking of this and wondering how she got arrested, charged, and convicted. If she had been a cop, and had shot him fifteen times, it would have been absolutely justified as the cop was afeared for his life from the unarmed man. The DA wouldn't have even read the reports, much less taken it to a Grand Jury. But because Jennifer was a private citizen, those standards do not apply. She retreated, and he chased. He smashed down a door to get to her. I agree with the appeals court that this evidence showed that he was violent, and a danger.

The Prosecutor argued that she didn't need to stab him in the chest, which is funny since the Prosecutors almost never argue that the cops are out of line for shooting unarmed people who just walk towards them.

Well Jennifer will be free soon, and the DA is trying to decide if they can appeal the decision of the Appeals Court. Because, Justice demands it. Or something.
