Twenty-seven-year-old Nicholas Caspers is to stand trial in Bismarck beginning Nov. 30 in the death of 30-year-old Paul Varner. The Bismarck Tribune says Caspers had been free on bond since making his initial court appearance March 4.
Caspers, who lives in Bismarck, admitted he had gone to Wishek on Feb. 27 intending to fight Varner. Both men had been drinking that night, and Caspers said he went over to Varner’s home after a heated telephone conversation early in the morning on Feb. 28.
Varner sustained head injuries and died of an upper airway obstruction from multiple facial fractures and bruises, according to Dr. William Massello III, the state forensic examiner who testified at the preliminary hearing.
The plea agreement calls for Haskell to require Caspers, who is being held at the Burleigh County Detention Center, to serve between six and 10 years in prison, pay $40,000 in restitution and serve five years of probation.
