I thought Europe thought we should not hold any that we weren't charging with crimes? Be careful what you wish for, ala Germany and our military bases. Rumsfeld is going to be able to release these prisoners, a matter of when not if...

Guantánamo prisoners win transfer reprieve

The Bush administration ran into its first roadblock in its plans to sharply reduce the prison population at Guantánamo Bay at the weekend, when a US judge forbade the transfer of 13 inmates to Yemen for fear they would be tortured.
Saturday's ruling by a US federal judge in New York marks an early victory for human rights organisations in their efforts to bar the administration from carrying out plans to bring down the prison population at Guantánamo by transferring inmates to Saudi Arabia, Egypt and Yemen.

It bans the transfer of the Yemenis until a hearing can be held on their lawyers' request for 30 days' notice before any transfer.

"We're relieved," Marc Falkoff, a lawyer for the Yemenis, told the New York Times...

Nope first it was the 'cruel Americans' for holding. Now it's the 'cruels Americans' for returning. Go figure.
 
well this is a very simple and legal fix.

build small INS office in Gitmo. Hold deportation hearings. send detainee back to yemen.

Well, that's one way. I'd prefer a cannon of sufficently large caliber which would allow a terrorist to be stuffed down its bore. Insert terrorist, aim the thing in the general direction of his country of origin and pull the lanyard.
