Scalia is a white guy. And the liberal narrative, especially by radical leftist blacks is by virtue of his skin color and political ideology, a racist.

And this is why Supreme Court justices have life tenure.
 
Well the Texas plaintiff is a joke because she didn't finish in the top 10% of her HS class, so she failed to meet Texas criteria even if the scotus says race cannot be considered. But, there's something at play other than race, which Scalia chooses to ignore, which speaks ill of him and points more to racism than just noting some kids finishing in the top 10% of their HS class are not prepared for UT at Austin. Texas is so large, and the quality of public HS varies so wildly, that even if UT Austin just takes the top 10% some of those kids (probably most often black or latino) will be less prepared than others. And the only tool to help them is giving them special help like academic coaches and remedial classes.

Taking the top 10% of all HS is not in itself racist, because it would create a racially diverse student body. But ignoring the fact that even a race neutral admission policy that would result in a non-segregated university (and UT Austin was segregated by law years ago), but with students from less affluent sch. districts needing academic help is just ..... old and out of touch.

So, it would be acceptable to you to have a publically funded education system that operates to prepare students from affluent pub sch districts to be admitted to the public university offering the most prestige at substantially greater %'s than less affluent sch. districts?

What Scalia said wasn't racist. But, if you have a public education system that is preparing a greater % of students to attend a flagship public university from affluent pub sch districts than less affluent pub sch districts that is not really a meritocracy.
 
Scalia just voiced something that is well-known. Several studies and papers affirm that students that cannot perform well in elite institutions are bound to failure unless those institutions offer program in things like Gay and Lesbian Haiku or Black Studies.

Unfortunately, a student whose entering academic credentials are well below those of the average student in a particular school will likely earn grades to match. Even former Princeton President William G. Bowen and former Harvard President Derek Bok, who were pioneers in formulating affirmative action policies, admit that the credentials gap has serious consequences. In The Shape of the River, they wrote, “College grades [for beneficiaries of affirmative action] present a … sobering picture…. The grades earned by African-American students at the [elite schools we studied] often reflect their struggles to succeed academically in highly competitive academic settings.”
