In May of 2014, BreakingBrown reported the case of a black man who was arrested by a plainclothes officer for drinking iced tea in a parking lot in North Carolina in 2013. We are happy to report that two years later, the man has finally been cleared.

"Christopher Lamont Beatty, 28, was arrested on April 27, 2013 in the parking lot of ABC liquor store as he drank Arizona iced tea. The plainclothes officer demanded that Beatty turn over his iced tea, but Beatty refused, explaining that he was drinking half-n-half, which is iced tea mixed with pink lemonade.

Beatty was then wrestled to the ground and charged with trespassing and resisting a public officer after the incident."

In a liquor store parking lot an officer wanting to sniff the tea for alcohol isn't unreasonable, and resisting such a command IS illegal.
 
This suspicion of alcohol in a non-alcoholic container is no different than the reasonable suspicion someone acting impaired smoking a cigar may have taken the tobacco out of it and replaced it with cannabis.

Judge made a partially wrong decision imo. Should have thrown out the trespassing charge but sustained the resisting charge.

Actually it is unless the officer suspects him of a crime. Asking to sniff someones drink for no reason isnt an officers job.

Notice that after he refused....what happened? Thrown to the ground and the obligatory cherry on top....Resisting.

Crime's drinking alcohol in public (assuming that's illegal there, usually is.) So asking to inspect the container in front of a liquor store is a 'reasonable request.'

Whole thing could have been avoided by simply complying with the officer's request, making some sort of sympathetic remark, "I guess it did look iffy, I don't blame ya Sir." and going about your way.

These things only escalte when people get snippy and start resisting. Guy;s lucky he only got thrown down. Others have gotten shot.

How would the cop know anything about a shit type attitude if he never approached him?

His shitty attitude is what caused him to be arrested AFTER he was approached. The fact that he was drinking in front of a liquor store is what prompted the officer to approach him. It was a black neighborhood. Anyone he approaches there is going to be black, so just stop with the race baiting.
 
Yeah because AFTER he was approached it was clear the cop accused him of committing a crime for no reason. Generally people don't appreciate being accused of a crime for no reason.

If the cop didn't approach, a shitty attitude would've never been known.
