The first case against Samsung in Europe over supposed patent infringements has come to an end in the Netherlands and it was a massive defeat for Apple. Of course the media are spreading the lie that it was a victory... I am hoping that it is not the usual Apple bias, but a lack of translation yet, as the news is pretty new.

BBC News - Euro ban for Samsung Galaxy phone

Out of all the infringements that Apple claimed that Samsung had done, Samsung got "busted" on one only. The patent that they violated was a patent in conjunction with the photo scrolling of the TouchWiz part of the Samsung software. As long as the Samsung Phones have this small bit of the software that violates the patent, then in 7 weeks time the phones will be banned across Europe. Problem is... Samsung have already said they would change that small bit of software so that they are not violating the patent, and wupti there is no ban in 7 weeks all of a sudden.

ALL other claims were dismissed and even at least one patent was declared null and void.

This means the claims of "they look like our stuff" was throw out for both the Galaxy phones and the tablets, which was/is one of the core claims Apple has been using world wide against Samsung.

Next stop is the German courts who should make a similar conclusion. Guess Apple's photo-shopping of evidence material did not pay off as they had hoped...

"Attached hereto as Exhibit D is a true and correct copy of a still image taken from Stanley Kubrick's 1968 film "2001: A Space Odyssey." In a clip from that film lasting about one minute, two astronauts are eating and at the same time using personal tablet computers. The clip can be downloaded online at [ame=http://www.youtube.com/watch?v=JQ8pQVDyaLo]clip1: Apple iPad in the 1969 classic: 2001 A SPACE ODYSSEY - YouTube[/ame]. As with the design claimed by the D'889 Patent, the tablet disclosed in the clip has an overall rectangular shape with a dominant display screen, narrow borders, a predominately flat front surface, a flat back surface (which is evident because the tablets are lying flat on the table's surface), and a thin form factor.
