I can't speak for the DoJ but it looks to me like they didn't think they had evidence to prosecute Trump as part of the scheme.

They did prosecute Cohen because the DoJ said it indeed was a campaign donation. Saying otherwise is ignoring the facts of his prosecution.

The principle is the same here.

Paying off these women was done to support the campaign. Therefore, the money is a campaign expense and needed to comply with campaign finance law.

This means contribution limits. It also means that it needs to be recorded on FEC forms.

In both circumstances, the government is saying that they were SUPPOSED to use campaign money, but didn't.
