An Afghan human rights body has condemned the new “Criminal Procedure Code” issued by Taliban-ruled Afghanistan, saying it legitimises discrimination and abuse. The code categorises citizens into four classes, explicitly recognises slavery (termed “ghulami” or “ghulam”) as a legal status, and grants mullahs and clerics immunity from criminal prosecution.

Punishments for the same offence in Taliban-controlled Afghanistan will now vary based on the offender's class, Rawadari, the human rights body said.

According to Article 9 of the new code, the top spot among the four classes will be occupied by the religious scholars or mullahs. If the mullahs commit any crime, they would just be advised, while those at the bottom of the social class would be subjected to imprisonment and corporal punishment, it pointed out.

Taliban “supreme leader” Hibatullah Akhundzada recently approved a novel criminal code, multiple outlets reported this week, that dramatically expands the legal ability for men to physically abuse women and children and provides for the creation of a formal “slave” class in the country.
The Taliban is a radical Islamist terror organization that currently operates as the uncontested government of Afghanistan. The Taliban returned to power on August 15, 2021, following former President Joe Biden’s decision to extend the 20-year-old Afghan War beyond the deadline of May 15 of that year that President Donald Trump had previously agreed to. The Taliban’s return to power prompted a chaotic mass exodus of Afghans fleeing the nation’s persecution and the imposition of restrictive sharia policies that have stripped Afghan women and girls of nearly all their rights as citizens.
According to the Times of India, the latest affront to human rights from the Taliban is the publication of a 90-page criminal code, issued as an edict recently, likely in late January. No evidence suggests any public participation in the drafting of the code or legislative debate by certified lawmakers prior to its imposition.

Human rights activists, long advocating for more international interest in stopping the rampant abuses in Afghanistan, were quick to condemn the latest penal directives from the Taliban.
“This is not just discrimination,” an unnamed human rights activist told the Asian news and commentary outlet The Diplomat. “It is a legal strategy to control society by separating people into groups that can be treated differently.”
The Diplomat noted the sudden announcement of the code without a “public announcement, national debate, or open process,” highlighting the use of “slave” categories for certain Afghans as “especially troubling.”
“Punishments depend on a person’s status, which creates inequality and removes the idea of equal protection,” it explains. “As a result, poor and marginalized people can face harsh penalties, while those with power often avoid serious consequences… Several articles use the word ‘slave’ many times, and the code separates ‘free’ people from ‘slaves’ in legal terms.”

The Taliban has also outlawed education for girls and women. As of August, the United Nations estimates that 1.4 million girls have been deprived of a secondary education in the country since 2021.

BTW... Groups referred to as the "Taliban" are currently driving a significant surge in violence and regional instability in Pakistan. This primarily involves the Tehreek-e-Taliban Pakistan (TTP), or "Pakistani Taliban," which has escalated its insurgency since the Afghan Taliban returned to power in 2021.
While the Pakistani Taliban (TTP) is a separate group that has targeted Pakistan, they share strong operational links with the Afghan Taliban, whose victory was welcomed by Pakistani leadership and especially ISI, Pakistan's CIA.
They've created their own "Frankenstein" monster.

The moderate Islamic terrorist state of Talibanastan (they must be moderate, after all we did a deal with them and we’re still negotiating with them) has explained that in its moderate approach to Islamic law, beating women is encouraged, but they draw the line at breaking bones.
Truly, Islamists in America have told us that Mohammed was the original feminist.

The Taliban has passed a law that allows men to beat their wives as long as it does not cause “broken bones or open wounds”. ​

The Telegraph obtained the 60-page penal code – signed by Hibatullah Akhundzada, the Taliban supreme leader, and distributed to courts across Afghanistan – which classifies spousal beatings as “ta’zir” – discretionary punishment – rather than a criminal act. ​

A husband may strike his wife and children freely, provided the violence does not leave visible bone fractures or open wounds. ​

Even where serious injury can be proven, the maximum sentence is 15 days in prison​

This is Islam. Every last part of it grounded in the Koran, in the crimes of Mohammed and in Sharia Islamic law.
The Taliban aren’t doing anything extraordinary here. They’re just dropping the pretense maintained by some.
Since Islam is moderate, then beating women is moderate too. We can only condemn the extremists who beat women so hard that they break bones.
