The in common use argument is dumb.......what do we do when a new technology comes out, and the gun grabbers tell us we can't have it because it isn't in common use....?

Dumb or not, its what we have.
It is certainly useful enough standard for current weapons.

We always have to be ready for the fight in the future.....the government will always get the latest weapons.......this standard of "in common use," will give the democrats and political left the ability to keep us from having those weapons...something to keep in mind.
 
Mexico should be able to sue Barry Hussein and the ATF for shipping thousands of illegal weapons to Mexican drug cartels under the insanity of "Operation Fast/Furious" and losing track of them.

Use the 1st Amendment as an argument. Cellphones, computers, the internet, and other communication technology wasn't in common use when the Constitution was ratified but it is still covered under freedom of speech.
