Funny story, but one that will undoubtedly end with the suit being thrown out. The mechanism for this sort of thing is to have the judge throw it out. Any other mechanism would add another level to an already burdened justice system and could lead to other cases of more merit being thrown out unfairly. It's the judge's job to make this sort of ruling. Let him/her do it. We don't need more hearings.
