If Hayes estate wanted to be associated with Trump then they would not have file a lawsuit. Also if Trump had asked for permission then he would have gotten a definitive answer. Hayes is barking up the wrong tree. It's the responsibility of the venue or DJ to get a PPL, not Trump.

Of course Hayes knows that, he's just filing a frivolous lawsuit to be a scuzzball.

Unless the copyright has fallen into the public domain, the estate can file a cease and desist. If there is an estate. Sometimes people think they are an estate when they are just relatives. Trump never claimed that he wrote the piece and never performed it for compensation. Cease and desist is likely all they can get.
