A Missouri law declaring some federal gun regulations ā€œinvalidā€ is unconstitutional because it violates the U.S. Constitution’s supremacy clause, a federal appeals court in St. Louis unanimously ruled on Monday.


A three-judge panel of the Eighth Circuit Court of Appeals agreed with a district court ruling from last year that blocked Missouri from enforcing the Second Amendment Preservation Act, a law passed in 2021 that penalizes police for enforcing certain federal gun laws.

Among the law’s provisions is a $50,000 fine for law enforcement agencies thatā€œ infringeā€ on Missourians’ Second Amendment rights.
 
The Missouri law is correct.

The lower courts are wrong, and even if SCOTUS accepts the appeal and agrees with the lower courts, well SCOTUS has been wrong numerous times. Dred Scott, Plessey, Koramatsu, Roe, are four easy ones where SCOTUS was wrong.

It's all stupid and another example of politicians pontificating over nothing.

We are discussing Federal Laws. Local law enforcement does not enforce Federal Laws. They could only enforce state laws.

If you have an issue with Federal Laws you need to get your reps to change them or get them in front of the Supreme Court.

This law in actual use did absolutely nothing. The state wouldn't be able to "fine" a Federal Law enforcement officer from enforcing federal law either.

First... That's not what the law says.

The law says Missouri law enforcement will not enforce Federal law, nor work with Federal Law Enforcement on federal firearm law investigation.

And you can't make us. Sorry...but you liberals set this precedent with your refusal to cooperate with federal immigration law.

So, you're either beat...or get ready to be forced to enforce federal immigration law
under the Trump DOJ.

Cause don't think for a new york minute we won't use this against you if we lose.

Second...if a police office infringes on the Second Amendment rights of a citizen... they SHOULD be personally fined...and 50k is enough to make them think twice before doing so.

Lastly...this will be overturned.

The federal government can't force us to help them. That's federalism. The federal government has no authority to compel our state government to assist them.

We're not keeping them from passing laws and we aren't keeping them from enforcing laws...we're simply not going to involve our state and local law enforcement in those enforcement.

You want to do it...be my guest...but don't look to us for help.
