Doesn't sound like much of an offense to me. Of course, I couldn't read the money grubbing Times' account of it without buying a subscription. To me, the NYT is far worse than coach Smith.
 
The university will lose in this matter. Surely there is a clause in the contract that mentions conduct that could be detrimental to the University, but this is thin gruel indeed. He was LIVING IN A MOTEL at the time in question, so having women come to his hotel room is a non-issue. The fact of the affair is something that is easily rebutted by the principals, and the appearance of impropriety is a concept that died around the same time as Commodore computers.
 
It is in his contract. It won't be a crime, but it's a fire able action.

Elliott said Smith and the woman met “at an establishment in Athens” and he didn’t know she attended the university.

He added that they were “perfectly appropriate consensual adult relationship” for nearly four months before Smith ended things in November.

Elliott said that the woman did not work in the athletic department.

The letter says the university does not have a policy barring employees from dating students.

Welp, after seeing all the OSU fans stand high-and-mighty and condemn Michigan for Sherrone Moore and his cheating on his wife and having an affair with his assistant... I'm guessing they'll have to shift their goal posts to swallow this one.
 
This sounds to me like the school was looking for a reason to fire this guy. If he had a record like Coach Saban, he could have screwed half the cheerleading squad and the Dean's daughter, and nobody would have said anything.
