- The Order and Initial Transfers: In 2023, the annual National Defense Authorization Act (NDAA) included a provision mandating the Pentagon develop a plan to sell or transfer excess border wall materials. Under this directive, about 60% of the materials, including bollards, panels, and gates, were transferred to states along the US-Mexico border (like Texas and California) and to U.S. Customs and Border Protection (CBP).
- Sale to GovPlanet: The remaining 40% of the materials were sold to GovPlanet, a company specializing in government and military surplus, in June 2024. These materials were subsequently moved to Arizona and listed for auction on GovPlanet's website, with some items starting as low as $5.
- Controversy and Legal Action: The auctioning of these materials sparked controversy, with some critics alleging that the Biden administration was intentionally disposing of usable materials at a loss to hinder future border wall construction efforts. Texas Attorney General Ken Paxton filed a motion to halt the sale, arguing that it violated a previous court order requiring the Biden administration to use congressionally-allocated funds for border barrier construction.
