So here is what will happen, in my opinion. Contracting out of work will escalate. The contracting companies will have less then the maximum number of employees. There will be many more "temp" workers.
They wrote a law they are now finding is unworkable and now to cover themselves that are unconstitutionally changing it on the fly.
The intent was affordable care for all. The result will be, as with all things liberal, the exact opposite. Less people getting health care through their companies affordably.
