Oh, heavens. Is there no PC syrup myth that you don't swallow? The number of slaveholders had dropped by 5% in the 10 years between 1850 and 1860. Slavery was absolutely not only dying but dead in the territories--there were fewer than 200 slaves in all the western territories, and nobody but nobody believed there was any chance that any territory was going to enter the Union as a slave state.
As for the Confederacy, its constitution allowed for the admission of free states to the Confederacy, and it also banned the slave trade.

Just FYI, when the Confederacy was formed, there were more Union slave states than there were Confederate slave states. The four Upper South states *rejected* secession over slavery; they only joined when Lincoln announced he would invade the South after Fort Sumter.
