VA Judge DiMatteo issues TRO on Youngkin's mask order, gives green light to child abuse in schools

I disagree with the ultimate result but it was the correct ruling for a TRO, under the irreparable harm standard. The judge made the right decision.

The Judge ought to have required petitioners to show evidence that Governor Youngkin’s order was not advancing the general welfare of the children and parents involved.

Additionally, the Judge’s ruling pretends a newly elected governor is bound to follow a previous governor’s executive order, which is flat out BS!


Finally, even King Fauci recently expressed concern about the impact on school aged children when he said “hopefully” forcing young children to wear face masks won’t have any “lasting negative impact” on them.

His wording confirms there is a negative impact. His only question is, is it “lasting”?

I don't agree that the order should be stopped, but it does qualify for a TRO, which only lasts 14 days in Texas. Don't know about Virginia.

We are talking about the rule of law. See the RULING in which the School Board is relying upon CDC information which is not in harmony with current established facts.


“The School Boards complain that EO2 undermines the clear authority vested in them by the General Assembly in SB 1303 to implement a re-opening plan consistent with the information provided by the Centers for Disease Control and Prevention (“CDC”). Specifically, the School Boards argue that the CDC’s guidance for in-person learning in schools recommends “universal masking” - that is, that everyone in the school setting must wear a mask at all times. The School Boards explain that they adopted the CDC recommendations and determined that a mask requirement for everyone was feasible and indeed practicable and has been implemented. EO2 essentially removes the universality of masking by allowing parents to decide whether wearing a mask is in their child’s best interest.”

The School Board opened the door to the legitimacy of their decision making when they introduced the CDC in their petition to the court. Unfortunately, Judge DiMatteo refused to do her job and question the School Board’s decision which amounts to child abuse considering there is no legitimate reason to force children to wear masks in the schools in question.

So why did Judge DiMatteo embrace child abuse and avoid delving into the legitimacy of the School Board’s decision making when they themselves opened the door in the courtroom to get a TRO?

You are the one who brought up the subject of what defines abuse in post 4. It discusses parents and what constitutes child abuse. Why bring it up if it didn’t apply to parents and the issue of mask wearing?

Any person 18 years of age or older, and that would include teachers in government schools and School Board members imposing rules amounting to child abuse.
