A federal judge ruled that the organization does, indeed, have the constitutional right to limit the number of heterosexual players on each team? WTH??? This whole idea of 'protected classes' has got to go.

Would he have said the same is the NBL said 'No Gays' or 'Only one fag per team'?

Methinks there'd be a million angry neolefties screaming about this if it were the other way around
 
Let me guess: The Bi-Sexual guys are the pitchers, and the Gays are the catchers right? :lol:
 
U.S. District Judge John Coughenour ruled Tuesday that the organization has a First Amendment right to limit the number of heterosexual players, much as the Boy Scouts have a constitutional right to exclude gays.

"It would be difficult for NAGAAA to effectively emphasize a vision of the gay lifestyle rooted in athleticism, competition and sportsmanship if it were prohibited from maintaining a gay identity," the judge wrote.

However, Coughenour did say that questions remain about the way the softball association applied its rule, including whether the questions asked about the men's sexuality at a protest hearing were unnecessarily intrusive. Therefore, the case can proceed toward a trial set for Aug. 1, he said.

The judge’s ruling is consistent with Boy Scouts of America et al. v. Dale (2000), where the Court held compelling the BSA to allow gay scout leaders violates the organization’s freedom of association allowing private organizations to retain their unique composition.
