Interesting that a woman appointed by Obama sees enough harm to a private, non church, company to issue an emergency injunction.

Supreme Court Justice Sonia Sotomayor late on New Year’s Eve blocked Obamacare’s requirement that a care facility for the elderly run by Catholic nuns provide contraception coverage to its employees.
The requirement was due to go into effect on Jan. 1 for the non-profit company and other religious-affiliated institutions across the country. Several lower courts on Monday granted similar emergency petitions, but a request from the Little Sisters of the Poor Home for the Aged in Denver was denied, prompting its lawyers to go to the Supreme Court.

Incorrect:

In her order, Sotomayor blocked the government from enforcing the requirement on the Denver home until further notice from the Supreme Court. The government has until Friday at 10 a.m. to respond.

What Justice Sotomayor ‘sees’ are similar cases pending before the Court; her ruling has nothing to do with the merits of the case.

And the injunction is temporary pending the government’s response.

No, asswipe, what Sotomayor sees is the Rule 65 which bars a judge from issuing an injunction without notice only if the petitioners can prove irreparable and immediate harm. Look it up if you don't believe me, and then come back and pretend you always knew about it.

While I realize that an elderly care facility, run by Catholic nuns, would never even be considered as having a need for contraceptive coverage, I do agree with the President's team that having everyone, yes everyone, contributing to the premiums for everything. After all, a family plan includes maternity care, and the husband will never use this care himself. A family plan also includes male reproductive illnesses and diseases, which the wife will never use herself. So regardless of who or what is covered under each specific plan, the overall system uses the premiums of every premium payer to cover everything for every covered person. With this in place, no one medical issue will ever be labeled by insurers as "uncovered".

It's going to be interesting to see how the Sisters have suffered a "substantial and impermissible burden"by simply filing out a form.

Yes, the issue in this case seems to be that filling out the form. Just filing an automatic waiver.

That's it.

Catholic Employers Claim That Filling Out an Obamacare Form Violates Their Religious Freedom
"Late on New Year's Eve, Justice Sonia Sotomayor granted a small number of religiously affiliated groups a temporary injunction from a provision in the Affordable Care Act that allows them not to cover contraception in their health care plans if they fill out a form that states that they want an exemption from the law for religious reasons.

Go ahead and read that sentence again.

These Catholic non-profits that wanted an exemption from covering their employees' contraception needs—and got an exemption from covering their employees' contraception needs—are now fighting the provision (that exempts them from covering their employees' contraception needs) simply because they don't want to have to fill out a form that states that they are exempt.

Why? Because their employees need that form in order to get birth control directly from their insurers (which they need to do because their employers—these Catholic non-profits—are exempt, as they want to be)."

Yes, filling out a form. That's it. Their religious sensibilities are insulted by merely stating on paper they have religious objections.

How's that for taking it a wee bit far?

They managed to convince a Supreme Court Justice appointed by Obama that the burden was real, even if you don't see it.
