After numerous delays, a high court in Bangladesh refused to hear the bail petition for photographer Shahidul Alam, who has been held in jail without charge since August 5. The two-judge panel told Alam’s lawyers to seek bail from another court. This was the fifth time Alam’s lawyers had sought his release on bail, according to numerous news reports.

During the brief hearing on November 1, the judges noted inconsistencies in the police report that was filed after Alam’s arrest.

Alam has been accused of violating Section 57 of Bangladesh’s Information and Communication Technology (ICT) Act, which criminalizes sharing of information that “prejudices the image of the state or a person” or criticizes the government. He was arrested shortly after posting videos on Facebook and giving an interview to Al Jazeera television about the Bangladesh government’s attacks on student protesters in Dhaka. Human Rights Watch and press freedom groups around the world have called Alam’s arrest “politically motivated.”

Judges hearing Alam’s bail petition on November 1 asked to view the Al Jazeera video and Alam’s Facebook posts. Afterwords, they noted that details in the First Information Report (FIR) police submitted to the court after Alam’s arrest didn’t match the interview footage. According to one news report about the hearing, Justice S.M. Mozibur Rahman criticized the police investigator, saying, “You know nothing” in a loud voice.
