I never spoke of it or called it a "Republican" tactic. My point still stands what the President did was unconstitutional, but that in itself is not a crime, and he did nothing illegal.

The President takes an oath to obey the Constitution. If, as you admit, the President does something unconstitutional it is the very definition of "illegal". It takes a Supreme Court ruling to make it official but that 9-0 vote was a clear message that what Barack Obama did by declaring that in his eyes the Senate was not in session, was indeed illegal. When you do things that are illegal...by definition you are committing a crime.
