The National Right To Work (NRTW) joined by the National Federation of Independent Business (NFIB), and Coalition for a Democratic Workplace (CDW) took off the legal gloves and are forcing the Obama Administration to defend its unconstitutional appointments to the National Labor Relations Board (NLRB). Some say that President Barack Obama is creating a serious constitutional crisis.

This is the first legal challenge regarding these NLRB Board appointees who Obama appointed without a U.S. Senate confirmation process; but, more are expected.

Washington, DC (January 13, 2012) – Today, National Right to Work Foundation attorneys filed a motion in federal court challenging the legality of President Barack Obama’s recent purported recess appointments to the National Labor Relations Board (NLRB).

Obama is intent on putting through his agenda, regardless of the means. If that means shredding the COnstitution, fine. He has already expressed that he finds the Constitution inadequate.

Obama ended the constitution when he passed the ability for the US Government to detain criticizes indefinitely without trial… Oh and mandate that they buy stuff…

Given the rethoric on this board about Reagen, he didnt need congress.

Given the antagonistic relationship he has with the House leadership and the topic of this thread (namely, Obama being unable to get anything through the Senate), the notion that he dictates to Congress rings a bit hollow.

Good to see somebody is finally challenging it because the Republicans are sure too damn chickeshit to stand up to him.

The Senate is currently controlled by the Democrats, in case you missed it. They seem to be in session when they want to pass shitty legislation and in recess when they want Obama to make shitty appointments.
Totally unconstitutional. No leg to stand on. If Bush had done this the libs here would be screaming for impeachment.

Jeez. That post involves a little hyperbole. It entails a little bit of some Chicken Little "the sky is falling" alarm-ism.

I can't abide this President as President, but he didn't "pass" anything and the bill he DID sign does NOT provide for the ability of the US Government to detain citizens indefinitely without trial.

Uh huh sure. If the Democrats controlled the Senate, President Obama would have no problem getting the appointments past the advise and consent hurdle. Nope, they have a simple majority. They do not control the process. But I'm sure you are for a straight up confirmation votes on the Senate floor without the threat of a filibuster right?
 
Even if these business organizations have standing to sue – which is in of itself problematic – the courts are not going to get involved it what is essentially a conflict between two branches of Federal government:

One problem with suing the White House over recess appointments would be standing. It’s unclear whether the courts would want to get involved in this at any level. And that may be why you just hear people like Mitch McConnell and John Boehner yelling about this being “unprecedented” without saying that the lawyers have been called or anything like that. McConnell would only determine the move on “uncertain legal territory.”

In addition, GOP leaders have no desire for the courts to make some definitive ruling as to what constitutes a recess appointment, as not to limit a future republican president’s like appointments.

The constitution explicitly grants the President the power to fill vacancies when the Senate is in recess with commissions that expire at the end of the Senate's session. It's absolutely asinine to insist that Obama violated the constitution for exercising a power explicitly given to his office.

They were not obligated to give their advice and consent.

And until they do, the nomination was not confirmed. Period.

And pretending (i.e., outright lying and knowing damn well that he was lying AS he said it) that the Senate was in "recess" in order to bypass the advice and consent requirement is the Constitutional crisis in this matter.

Once again: in order for the President to exercise that authority, genius, the Senate has to be IN recess.

harry Reid is the senate majority leader, right? The Democrats are the majority party in the Senate, right?
Were you so concerned about up or down votes when the GOP held the Senate nad Bush was trying to get his judicial appointments through and teh Dems blocked them merely with the threat of the veto?
